Total Ratings Based on Unemployability Under 38 CFR § 4.16

This presentation, by Kenneth M. Carpenter, Esq., is intended to explore new ideas and concepts concerning the presentation, development and arguments related to claims for increased compensation for a total rating based on unemployability. Included is an analysis of the provisions of 38 CFR. § 416 with particular attention to understanding the various considerations of service connected disabilities which must be examined in order to determine whether the facts of your case implicate an entitlement to a total rating based on unemployability.

Also examined are strategies which can be followed to effectively present the issue of entitlement to increased compensation for a total rating based on the unemployability of the service connected veteran.
